Modern Slavery Statement

INTRODUCTION 

This statement is made pursuant to Section 54 of the UK Modern Slavery Act 2015 and Section 14 of the Australian Modern Slavery Act 2018 (collectively, the “Acts”) and constitutes the modern slavery statement of Five9, Inc., Five9 Aus Holdings Pty Ltd., and Five9, Inc. UK Limited in respect of the financial year ended 31 December 2023. 

At Five9, we aim for high standards of governance throughout our organization. We recognize the responsibility we have towards our stakeholders including our investors, customers, employees, communities, and society as a whole. Modern slavery is a grave violation of human rights and universally prohibited, victimizing millions of people globally. For the purposes of this statement, the term 'modern slavery' encapsulates slavery, servitude, forced or compulsory labor, and human trafficking (i.e., the practice of illegally transporting someone from one area or country to another, usually for the purposes of being exploited). We expect that our suppliers and partners do not use Modern Slavery in any of its forms in providing goods or services to Five9. This statement demonstrates our commitment. 

OUR BUSINESS, STRUCTURE AND SUPPLY CHAINS 

Five9 is a pioneer and leading provider of cloud software for contact centers. Since the Company’s inception, it has exclusively focused on delivering its platform in the cloud and disrupting a significantly large market by replacing legacy on-premise contact center systems. 

The Company’s purpose-built, highly scalable, and secure Virtual Contact Center, or VCC, cloud platform delivers a comprehensive suite of easy-to-use applications that allow simultaneous management and optimization of customer interactions across voice, chat, email, web, social media, and mobile channels, either directly or through application programming interfaces. Delivered on-demand, the solution enables clients to quickly deploy agent seats in a geographic location with only a computer, headset, and broadband Internet connection, and rapidly adjust the number of contacts center agent seats in response to changing business requirements.

In order to provide our products and services, we procure a range of goods and services from third party suppliers and partners who may, in turn, enter into sub-contracts with additional suppliers. We may also, from time to time, outsource some of our back-office functions to various suppliers and partners. Supply categories include IT and technology, consulting, office space, office services (including the provision of security, catering, office supplies and cleaning), professional services, and business travel. 

POLICIES 

Five9 is committed to the highest standards of ethics and integrity. We will not tolerate modern slavery, and we are committed to taking effective steps to mitigate the risk of modern slavery in our operations and supply chain. 

Our Code of Ethics and Business Conduct requires all officers, employees, and directors to observe the highest standards of ethics and integrity in their conduct. We work to deal fairly with each other and with the Company’s customers, suppliers, and competitors. 

Our Supplier and Partner Code of Conduct requires our suppliers and partners to observe the highest standards of ethics and integrity in their conduct and comply with laws and regulations that are applicable to and critical to our business and values. 

PROCEDURES AND STEPS TO MANAGE RISKS 

Given the nature and location of our own operations, the risk of modern slavery within our business is considered low to moderate. We recognize, however, there are still some risks, and we take such risks very seriously. To that end, we do the following:  

  • We set clear expectations, through our Supplier and Partner Code of Conduct, that our suppliers and partners comply with all applicable laws and regulations, including in relation to modern slavery and labor law. Should Five9 be made aware of any policy violations or issues related to slavery and human trafficking, we will immediately assess and determine what further action is needed. 
  • We set clear expectations, through our Code of Ethics and Business Conduct, that our employees comply with our values and ethics. Our Code of Conduct requires colleagues to act fairly and ethically in all that they do. Should Five9 be made aware of any policy violations or issues related to a violation of such code, we will immediately assess and determine what further action is needed. 
  • We have an independent system in place to encourage any reporting of concerns and the protection of whistleblowers. Five9 employees, partners and suppliers may access the anonymous and confidential reporting system online at https://www.openboard.info/FIVN/index.cfm or, for employees, by calling the toll-free numbers as listed on the Company intranet. 

TRAINING

Upon hire, Five9 shares with all employees our Code of Ethics and Business Conduct. 

EFFECTIVENESS 

We will continue to review the effectiveness of the measures we take in ensuring that there is no modern slavery in either our business or our supply chains, and we will use this to inform the further development of our policies, procedures, and best practices.
